Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of FullMats (fullmats.app) and its related services ("the Service"), operated by Torres Global 369, LLC doing business as FullMats ("we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Description of Service

FullMats provides AI-powered conversational assistants and lead management tools for martial arts gyms. The Service includes:

• An AI assistant ("Alex") that responds to prospect and member inquiries across messaging platforms
• Automated trial booking, reminders, and follow-up communications
• An owner dashboard with analytics and conversation transcripts
• SMS and messaging integrations via third-party platforms

Eligibility

You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or the business you represent. By using the Service, you represent that you meet these requirements.

Account Registration

To use the Service, you must provide accurate and complete information during setup. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Send spam, unsolicited messages, or deceptive communications through the Service
• Attempt to reverse-engineer, copy, or create derivative works based on the Service
• Interfere with or disrupt the Service or its underlying infrastructure
• Use the Service to collect personal information without proper consent from the individuals involved
• Misrepresent Alex as a human when directly asked by a prospect or member

Gym Owner Responsibilities

As a gym owner using FullMats, you are responsible for:

• Ensuring your gym's use of the Service complies with all applicable privacy and messaging laws, including TCPA, CAN-SPAM, and any state-specific regulations
• Obtaining appropriate consent from prospects and members for AI-assisted communications and SMS messaging
• Providing accurate gym information (schedule, pricing, policies) for Alex to reference
• Reviewing and responding to escalated conversations in a timely manner

Billing and Payment

Paid plans are billed on a monthly subscription basis. Payments are processed by our third-party payment provider. You will see Torres Global 369, LLC (or "FullMats") on your billing statement.

• Subscriptions renew automatically unless cancelled before the next billing cycle
• You may cancel at any time — there are no long-term contracts
• Refunds are handled on a case-by-case basis at our discretion
• We reserve the right to change pricing with 30 days' notice

AI-Generated Communications

The Service uses artificial intelligence to generate and send messages on your behalf. While we design Alex to be accurate, helpful, and professional:

• AI-generated responses may occasionally contain errors or inaccuracies
• You are ultimately responsible for the communications sent from your gym's accounts through the Service
• We recommend reviewing conversation transcripts regularly through the owner dashboard
• Alex is designed to escalate complex, sensitive, or ambiguous situations to you rather than attempt to handle them

Intellectual Property

The Service, including its design, code, AI models, branding, and documentation, is the property of Torres Global 369, LLC. You retain ownership of your gym's data, branding, and content that you provide to us.

You grant us a limited license to use your gym's information (name, schedule, pricing, policies) solely for the purpose of operating the Service on your behalf.

Data and Privacy

Our collection and use of personal information is described in our Privacy Policy. By using the Service, you agree to the practices described in that policy.

Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform maintenance, updates, or experience downtime. We are not liable for any losses resulting from temporary unavailability.

Limitation of Liability

To the maximum extent permitted by law, Torres Global 369, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to lost revenue, lost leads, or missed communications.

Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Indemnification

You agree to indemnify and hold harmless Torres Global 369, LLC, its officers, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

Termination

Either party may terminate this agreement at any time. You may cancel your subscription through your account or by contacting us. We may suspend or terminate your access if you violate these Terms or engage in conduct that we reasonably believe is harmful to the Service or other users.

Upon termination, your right to use the Service ceases. We will retain your data for 90 days as described in our Privacy Policy, after which it will be deleted or anonymized.

Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts located in Palm Beach County, Florida.

Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised "Last updated" date. Continued use of the Service after changes constitutes acceptance of the updated Terms.
